These Terms of Service (the "Terms") govern your access to and use of the website, online store, products, and related services operated by Stoked Dreamers LLC, doing business as Stoked Rincón ("Stoked," "we," "us," or "our"). Our website is powered by Shopify.

By visiting the website or placing an order, you agree to these Terms and to our Privacy Policy, Refund Policy, and Shipping Policy. If you do not agree, do not use the website or place an order.

These Terms do not limit any consumer rights that cannot legally be waived.

1. Eligibility and Account Information

You must be at least the age of majority in your jurisdiction to place an order. If you create an account, you are responsible for safeguarding your credentials and for activity under your account. You agree to provide accurate, current, and complete contact, billing, payment, and shipping information.

We may refuse, limit, or cancel an order where permitted by law, including when an order appears fraudulent, unauthorized, intended for resale, or contains inaccurate pricing or availability information.

2. Products, Product Information, and Availability

We strive to present products accurately. Colors, finishes, sizes, and other visual details may vary because of screen settings, manufacturing variations, or the handmade nature of certain products. Product images are illustrative unless stated otherwise.

Product descriptions, availability, pricing, and promotions may change without notice. We may limit quantities or discontinue products at any time. An order confirmation acknowledges receipt of your order; acceptance occurs when we process and ship the order or otherwise confirm acceptance.

Products from third-party brands may be subject to the manufacturer’s warranties, instructions, and limitations. Nothing in these Terms replaces those materials.

3. Surf, Water-Sports, and Outdoor Products

Surfing, swimming, paddling, and other water or outdoor activities involve inherent risks, including serious injury or death. Products sold by Stoked must be used only as intended, with appropriate skill, judgment, supervision, and safety precautions.

You are responsible for inspecting products before use and following all manufacturer warnings, assembly instructions, care instructions, and safety guidance. Helmets, leashes, flotation devices, wetsuits, fins, boards, and other equipment are not a substitute for training, lifeguard supervision, weather awareness, or good judgment.

To the fullest extent permitted by law, Stoked is not responsible for injury, loss, or damage resulting from misuse, modification, improper installation, failure to inspect equipment, use outside intended conditions, or use contrary to manufacturer instructions.

4. Pricing, Taxes, and Payment

Prices are shown in U.S. dollars unless stated otherwise. Applicable taxes, including Puerto Rico sales and use tax (IVU) when required, shipping, and other charges will be disclosed at checkout before you submit your order.

You represent that you are authorized to use the payment method submitted. We may correct pricing, typographical, or inventory errors and, where necessary, cancel affected orders and issue a refund for amounts paid.

5. Orders, Cancellations, Returns, and Refunds

Please review your order carefully before submitting it. We may be unable to change or cancel an order after it has been accepted, prepared, or shipped.

Returns, exchanges, refunds, store credits, exclusions, timelines, and procedures are governed by our Refund Policy, as well as applicable law. If there is a conflict between these Terms and a non-waivable legal consumer right, the law controls.

6. Shipping, Delivery, and Local Pickup

Available shipping and pickup options, costs, destinations, and estimated delivery times are shown at checkout or in our Shipping Policy. Delivery estimates are not guarantees and may be affected by carrier delays, weather, customs, supply disruptions, or events beyond our reasonable control.

For local pickup, you will receive instructions when your order is ready. You must present the order confirmation and a valid photo ID, or designate an authorized pickup person in advance. If an item arrives damaged, appears incorrect, or is missing, contact us promptly and retain the packaging and supporting photos so we can evaluate the claim.

7. Promotions and Gift Cards

Promotions are subject to their stated terms, may not be combined unless expressly permitted, have no cash value, and may be withdrawn or modified where permitted by law. Any gift cards sold by Stoked are subject to their disclosed terms and applicable law.

8. Intellectual Property

The website and its content, including its branding, logos, photographs, graphics, text, designs, videos, and product descriptions, are owned by Stoked or its licensors and are protected by applicable intellectual-property laws.

You may use the website for personal, non-commercial shopping only. You may not copy, reproduce, distribute, modify, scrape, create derivative works from, publicly display, or exploit any website content without our prior written permission, except as permitted by law.

9. Reviews, Feedback, and User Content

If you submit reviews, photos, comments, or other content, you represent that you have the rights necessary to do so and that the content is accurate, lawful, and does not infringe or violate another person’s rights.

You grant Stoked a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, adapt, publish, display, and distribute that content for operating, promoting, and improving our business and Services. We may remove content that we reasonably believe is unlawful, misleading, offensive, or inconsistent with these Terms.

10. Acceptable Use

You may not use the website to violate law or another person’s rights; submit false or misleading information; interfere with security or functionality; introduce malicious code; impersonate another person; send spam; collect personal information without authorization; or use bots, scraping tools, automated agents, or similar methods to access the website without our written permission.

We may suspend or terminate access for conduct that violates these Terms or threatens the website, our customers, or our business.

11. Third-Party Services and Links

The website may contain links to, or functionality provided by, third parties, including Shopify, payment processors, social-media platforms, and shipping carriers. Their services are governed by their own terms and privacy practices. Stoked is not responsible for third-party content, services, or transactions outside our control.

12. Privacy

13. Disclaimer of Warranties

Except as expressly stated by Stoked or required by applicable law, the website and Services are provided on an "as is" and "as available" basis. We do not guarantee that the website will be uninterrupted, secure, or error-free.

Nothing in this section limits a manufacturer warranty, a remedy stated in our Refund Policy, or any warranty or consumer protection that cannot legally be disclaimed.

14. Limitation of Liability

To the fullest extent permitted by law, Stoked and its owners, officers, employees, contractors, service providers, and licensors will not be liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, lost data, or loss of use, arising from use of the website or products purchased through it.

To the fullest extent permitted by law, Stoked’s total liability for a claim relating to an order will not exceed the amount you paid to Stoked for the product or service giving rise to that claim. This limitation does not apply where prohibited by law, including liability that cannot legally be limited.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Stoked and its owners, officers, employees, contractors, service providers, and licensors from third-party claims, liabilities, damages, and reasonable legal fees arising from your violation of these Terms, unlawful conduct, or misuse of the website or products.

16. Governing Law and Venue

These Terms and any dispute relating to them or your use of the Services are governed by the laws of the Commonwealth of Puerto Rico and applicable federal law, without regard to conflict-of-law principles. Subject to applicable law, the courts located in Puerto Rico will have exclusive jurisdiction over such disputes.

17. Changes, Severability, and Entire Agreement

We may update these Terms by posting a revised version on the website and changing the effective date above. Material changes will be handled as required by applicable law. Your continued use of the Services after the effective date of updated Terms constitutes acceptance of the updated Terms.

If any provision is held invalid or unenforceable, the remaining provisions remain in effect. These Terms, together with the policies expressly incorporated by reference, are the entire agreement between you and Stoked regarding the Services.
